Rob - Subject Access Requests? If so, I got mine yesterday and whilst I am asking for them to fulfill the actual request there is some "dodgy" stuff in it!

Happy Reading

Trev1234 yep, that's the one.

I've had a look through and there is nothing to my eye that would stand against my OH really, just had a quick read of your issue and wish you all the best with it!

Trev1234 teaboy2 - letter received via email inviting my OH to an appeal hearing on 26th August. Funny that the appeal is being conducted by a husband and wife team who make up 66% of the management team, with the other person also being part of the issue to begin with!
teaboy2 - emailed you some info

It will go against them at tribunal if the wife is not impartial to the incidents mentioned in the grievance or the first grievance investigation that they made a complete mess off.

teaboy2 just to clarify, the wife wasn't there, but she was there for the interview for the job. She hasn't been around when any of the incidents occur, but she is a part owner therefore has an interest in the nursery protecting itself, as well as being the wife of the bloke who is conducting the grievance and he grievance appeal

Which interview? Intial job interview or the grievance hearing?

Well 39 points, plus the added bonus of the fact that 24 hours ago they've posted a job advert for full time and part time positions!
Incredible!

Yes i have seen it. I would add on to the bottom of the documents she is taking with her.

Also on xx/xx/xx date i noticed a job advert on "website name" that was posted on the xx/xx/xx for part time and full time nursery assistants. Considering your alleging that i was let go on the basis you needed to cut 200hrs per month i was very surprised to come across your new job vacancy advert seek both part time and full time workers. The fact you are now advising for a minimum of 1 part time and 1 full time position contradicts your whole story on the need to reduce hours by 200hrs per month which was your sole reason for carrying out redundancy selection and terminating the contract signed under duress in June, and backed to 21st of April - This on balance of probability makes it clear you never needed to cut hours and every document you have produced has been fabricated simply in a vein attempt to cover up your wrong doings. Also, disputes regarding the contracts aside, the whole reason you dismissed me on the 21st of July was based on your alleged need to cut hours, where as the advertisement for vacancies shows your actually in need of additional staff to replace the one who retired and the one who resigned, positions i myself could have easily filled if it were not for myself being pregnant and therefore likely to be taking maternity leave in the near future if i had remained in your employment! The employment tribunal is going to see this for exactly what it is, a clear attempt to dismiss me on fabricated grounds as a result on my pregnancy!

Make sure you take a screen shot of the advert too and give your O/h one copy to take with her along with the document that included all the points. And make sure you keep a copy of the advert for your own records, as it will prove useful at ET.

teaboy2 ready for tomorrow now I think. Do I need to take any evidence, or just all of the notes and the copy of the job advert?

Also, I have sent you the notes just so you could check over the last couple of points to see if they need any more legal added to them?

Cheers

Take everything with you - so you can point out each thing as you go through the points with them, but make sure you do not let them keep your copies of the evidence they sent you mate!
