  • Can they do this?

    I want to know if the company I worked for could hire and fire me the way they did.

    I had an interview arranged by the apprenticeship training provider I was with at the time. I went for the interview which was about 2 hours away and needed 3 buses to get to. I was offered the job on the spot and started working 2 weeks later. I had a 6 month probation period. I was never asked for a P45 from my apprenticeship.

    I was put on the phones but did very little work related to them. I was then told that I would spend time in the workshop to "get some background knowledge" before going back on the phones and doing the work. I never had a 3 month probation meeting.

    Just before my probation was up I was called for a probation meeting. I was told that there was issues with my telephone skills and lack of confidence in the workshop and that they saw no point in continuing. They would pay me up to the end of the month but there was no point coming back on the Monday.

    Did they have the right to do this or did they fail to follow one policy or another.

    Hi and welcome.

    Unfortunately, you have very few employment rights until you have two years service. The "probation" period means little if anything.

    It sounds as though your employer has behaved in a shoddy fashion but there is little you can do about it.

    Bear in mind that you are entitled to payment for any holiday entitlement which may have accrued whilst you were working there, this may give you a little extra.
