  • No final pay.

Started working as an employee on 11th February. Received contract on 5th March but understood i was still on probationary period for 6 months.
Was dismissed on 25th March and ask to leave there and then, no explanation no notice just told "No longer required".
Was told final wages would be sent via post with p45 for security reasons, even tho i was usually paid by BACS.
Wages and p45 never received so i contacted my employer and ask if i could collect from office i was told, "You will not be collecting we have a procedure to follow. We do not reissue checks for ten days to allow for post". They said they had sent my cheque on 31st March.

I want to write a formal letter to my employer in respect of my wages but not sure how to word it, can anyone help please.... Im at my wits end and feel like i've been proper tucked up.

    Re: No final pay.

Write a letter headed FORMAL LETTER BEFORE ACTION:

In the letter write the background to the issue like you have done in your post above.

Then remind them that it is unlawful to withold wages under section 13 of the employment rights act 1996 and as you have not received your final wage (inclusive of accrued holiday entitlement and payment in lieu of notice) on the date in which you would have normally been paid, if you had not have been dismissed, then they are in breach of section 13 of the above stated act. As such if you do not receive the monies outstanding (include a detailed breakdown of what is owed to you with the letter) as per the break down included, then you will seek county court action to reclaim said monies owed to you.

Now work out what your accrued holiday entitlement (i.e. holidays you had earned during your time working for them) was and look at what notice period if any is owed - Check your contract for holiday entitlement and how it is worked out and same for any notice period for termination of employment that the employer most give to you when terminating your employment. Don't be afraid to ask us for help if your not sure about anything.

Ohh and by right they should pay your final wage by BACs not by cheaque, given it was by BACs that you were usually paid via.
