  • Redundancy two separate jobs same employer

Hi I need some help with a redundancy issue. Historically I held 2 separate jobs with the same employer. One being a part time admin and clerical post of only 4 hours per week which I worked in from 2001-2013 when the particular service disbanded I was offered voluntary redundancy. I accepted a small severance payment as this was a part time post at a lower grade than my other post. Running along side this post I also hold a substantive post as a clinician of 30 hours per week with continuous service from 1997, I have just been made redundant this time compulsory redundancy as the clinical post I have been doing no longer exists and no comparable jobs were available in redeployment.

Essentially each post had a different line management structure, pay bands, job description, pay slips, annual leave entitlement and to me and my union representative they were clearly two separate jobs. Unfortunately the HR director does not share this view and has only offered redundancy payment for 2 years 2013-2015 claiming I cannot be offered redundancy for the same service twice. I believe I am due redundancy for the 17 years I have spent in my substantive post, as I have worked in this area without a break in service in addition to my to other part time post.

I now need to consider my options and looking for advice.

    Hello and welcome.
Have you still got the documentation from your redundancy in 2013?
It may well be that the HR director doesn't know the proper story and thinks you were made redundant and offered a suitable alternative role.
It may also be that he's trying it on. This is more likely, frankly.
He's quite right that you can't be made redundant from the same service twice. And irrelevant. This isn't the same service.
You may have to approach the Tribunal. I'd write to the HR Director, pointing out the error and asking him to reconsider, in default of which you will contact the Tribunal Service.

Thank you for your response. I think your thoughts in the HR Director trying it is unfortunately the case. I do still have some of the documentation from my 2013 redundancy and have already shared this with him. I raised a grievance before I finished so that means that another senior manager will need to look at the case, so it gives them a final chance to get it right. Following that as you suggest it will need to go down the tribunal line.

Thank you for taking the time to comment, much appreciated.
