  • Changes to Terms & Conditions - Advice required please...

    Hi All,

Please can I have some views and advice regarding the following:

My employer has recently held a period of consultation regarding our shift pattern and hours of work... This was fine and the outcome is positive.

HOWEVER in sending out the new contracts they have added the following which WAS NOT part of the consultation and WAS NOT in our previous contract of employment:

Whilst there will always be occasions when short noticechanges are required for business critical reasons it isproposed that we will, wherever possible, observe thefollowing periods of notice going forwards:

    > Change of shift start/end time – at least24 hours’ notice by phone and followed upby email unless by mutual agreement

    > Change of working day/planned day offin the next or later block of shifts but inthe current rota period – by the end ofthe current block of shifts in person or byphone and followed up with an emailunless by mutual agreement

    > Change of Rota Line – in person or byphone before the end of the current rotaand confirmed by the issue of the nextRota unless by mutual agreement.

It should always be remembered that working days anddays off are not confirmed until a rota is issued – theplanning rota is for planning purposes only and is not tobe taken as a confirmed pattern.

I am sure that the above is not really allowed as why have a planning rota when they want to change shifts and working days as they please !!! We would not be able to make plans for our days off as they could then tell us we are working !!!

Any advice regarding the above would be greatly appreciated.

    Regards in advance....

Thanks for your reply - It is proposed - yes i accept that but they usually give less than that notice !!!

How about the last line regarding days off etc....

Also this new wording is in our new contracts - should they have stated that this was going to be added in the consultation ??? as surely they cannot just add to contract as there is no variation clause in place.....

      Thanks
