Hello everyone. I wondered if anyone knows if this is legal please?
My husband has worked for the same company for 16 years. He is contracted to 40 hours per week, and can be asked to work overtime (as per contract). New employees have different contracts.
For the first 10 years any hours worked over 40 was paid as overtime. They also run a bonus scheme. Over the past 5 years he has taken a pay CUT, "for the sake of helping to save the company" this was initially for 6 months but his full pay was not returned for over 2 years! He has not received a pay rise in 5 years, and they keep changing the bonus scheme so that he earns less and less.
They sent out new contracts 5 years ago which my husband refused to sign, and informed them that as far as he was concerned his original contract still stood.
During the last 5 years the company has been taken over by shareholders and the name changed, but he basically still works for the same people. During this time, he has been expected to work at least 50 hours per week BEFORE being paid any overtime and then they pay it at a rate of his basic divided by 40 hours at time and a half and double time if Sundays are worked. (so 10 hours worked for nothing, and they try to pass this off as "your basic reflects this"?
Is this legal?
