I am hoping that someone may be able to offer me some advice.
I currently work FULL TIME as an Emergency Medical Technician within the ambulance service...
Our shift pattern is currently 5 days on, 3 days off, 4 days on, 4 days off...
The company has recently taken 26 new members of staff on and is now wanting to change our rota / shift pattern...
We as staff have not been consulted at any step of the way…..
* As staff should we expect to be consulted ?? Is it a legal requirement ??
* Should we be given notice e.g.: 90 days prior to a change of shift after consultation period???
Here is some info that may help:
16th Dec 2014 - email sent out stating:
"As you are all aware, we have 26 new staff starting in January, these new staff will require a 'buddy' for at least their first few weeks on the road. To facilitate this there will be some amendments to rota lines, these will be confirmed over the next couple of weeks and will take effect from Monday 2nd January."
We have had no information as stated above within 2 weeks and also the 2nd January was a Friday - the 2nd Feb is a Monday so i think there is a clear typo there…..
Over the past week or so varying rumours have been circulating regarding differing rota patterns etc….A colleague emailed the management today and received the following reply:
"In response to your email in respect of change of rotas, I would like to offer you the following reply:
1. An email was sent out in December to all staff informing them of a change in rota in February, which gave adequate notice to staff that rota lines may be changing. This is due to an increase in *** requirements and opening up of the Sheffield base, and recruitment of new staff. Obviously, new staff will need to be mentored by experienced staff, therefore rota changes will have to take place to accommodate these changes
2. Any annual leave already booked will be honoured, however, we would ask staff to be flexible wherever they can, wherever it may be required during the transition of these new rotas
3. Planned rotas will be going out today, and we ask that you look at this, and if there are any issues please contact ******************** no later than Friday 23rd January 2015

Regarding the above the email sent out in december as mentioned in part 1 of the above is what is listed at the start dated 16th December so no consultation has taken place, also 3 months notice if required by law would mean a change of rota would not be implemented until March (is this legally correct?)
My contract states the following:
You will normally be required to work 40 hours per week which will be made up of PM that can be on any day of the week.
*** may alter your normal hours of work to meet the requirements of its business at short notice. (also my interpretation of short notice is 7 days, my employers interpretation is no less that 24 hours however this is not written down anywhere… does ambiguity in a contract side with the person that did not write contract????)
There is nothing in our contract regarding shift pattern etc….
The only line is this:
"*** reserves the right to make reasonable changes to any of your terms and conditions of employment and will notify you in writing of such changes"
Please can someone offer me any advice….
