  • Unfair dismissal?

Hi guys, first post here. I have recently been accused at work of drinking on shift by 2 people who have a personal grudge against me. I was on 6 months probation at the time. I have never drank on shift but they have made statements saying me and another employee have. Initially we were suspended, and then brought in for 2 hearings to hear the allegations and make our own case. At no point has it been proved we drank on shift, just the statement of 1 person that said he saw me. I received an email today saying I have been dismissed on the grounds of gross misconduct. Is this fair? They are going off one persons word against mine. This cant be right. Cheers for any help.

I have asked one of our Employment Law specialists to look in on this thread and advise.

        Thanks BlueBottle.

First of all, can you be a bit more precise as to the nature of the personal grudges? Were they a result of you making formal complaints against them, where they bullying you or harassing you.

Secondly, you said two of you were accused, what action was taken against the other person that was accused, if any? And what was the result?

As for the quoted post below - Please do not pay attention to advice given in Private messages, if that is what has happened.

You said you were on a 6 month probabtion period which depending on your answers to the above may mean you do not qualify for Employment Tribunal.
