    Hi,

    I'm hoping someone can offer me some advise here.

    Background:

    Within the company I work for, there are different grades and it is well known that I am on a lower grade than I should be. We asked human resources to carry out a grade review which determines whether you are on the wrong grade. They came back and told me that my current grade is correct. However, I have recently found from a reliable source that this wasnt the case...the review showed I should be on the higher grade and they lied to me.

    Is there anything I can do? The problem is, I work as a part of the HR function, and so the Exec who would have made this decision is my direct line exec.

    The whole situation is getting very frustrating!

    You have the right to view your personnel file and if nothing is held there, you can do a DPA subject access request in order to view what is held about your grade review.

      As Steve says.

      But remember there is no (legal) obligation on the employer to raise you to a particular grade or pay a particular amount of money,

        If you feel you cannot resolve this with your direct line manager, take it further up the food chain to someone you think may review it fairly.

          Agree with ssparks but presumably the review decision is documented somehow and that will establish whether you were "lied" to as to the outcome.

            Its a bit hit and miss to be honest, we need more details other than HR departments word against that of a 3rd party (which amounts to just hearsay). Are others in the same role or do same duties as you on a higher grade, what is the eligibility for the higher grade, is it based on duties, experience, qualifications/training recieved etc etc - As others have said, only way you will know is be getting a copy of the review!

            I think you'll find that's not entirely true! They have obligations not to treat employees less favorably than other employees (in this case paying less for carrying out same duties, whilst having same training/qualifications or level of experience). For example, if you have 1 years experience and another had 4 years, then its perfectly ok to pay different rate based on experience, but if both had 4 years experience, then pay rate would need to be the same. Otherwise your treating one employee less favorably than another - There is also the equality act 2010 that places legal obligations on employers in relation to pay, and that's just two possible examples
