  • Suspended, Dismissal Looming

    Hi

I was called into a meeting last Friday with my boss and HR. They handed me a letter which was a proposal to remove me from my senior executive role. His reasoning was that I was a bully (not true), my staff were leaving in droves (not true) and that no one wanted to work with me (several people said they enjoy working with me - including ex employees). He said that the HR Director had spoken to me several times about the issue of how I managed my team (not true). I was promptly walked out of the building in front of my team, my phone was taken from me and my remote email access was cut off. Right after the meeting, my team was told I had been terminated.

The employer (Australian state government!) has the legal right to let me go with our without cause, however they have no legal right to suspend me. Their response is to deny that I am suspended but instead I've been redirected to work on my submission to their allegations.

I have never had a written warning about my management style. My performance review was signed under duress (2 days after I returned to work from having a surgical termination of my 3 month old baby which was not expected to live). And last week they suspended me knowing I was scheduled this week to have further surgery because of an incomplete abortion.

I realise that it's obvious that my boss didn't like me. Though I don't know he hated me.

I'm paying a fortune for lawyers who are very good, but the employer doesn't seem to want to come to the table for mediation. Further, my employment arrangements exclude me from the Fair Work legislation which would ensure I had fair process. My only recourse is going to the Supreme Court which is very expensive but highly visible.

My reputation has been damaged. I've been contacted by several people from outside my employer who know I've been let go. The way they've handled this makes it appear that I've committed a criminal act (which I haven't).

Should I resign and possibly forgo any compensation? Would it really help me to retain my reputation (which had been great up until this job)?

Thanks in advance for any advice.

    Re: Suspended, Dismissal Looming

I'm really sorry for your problems and losses. This is a UK based site and I'm not sure that there are members versed in Australian law . However I would start looking for another job now , as it is obvious that they want rid of you . Are there any gender/ ethnicity issues which would be relevant in your defence.
00I would start gathering evidence contrdicting the allegation made talk to your lawers re an unfair dismissal case .
Sorry I can't help more but as I said at the start this is a UK site.

I'm gonna suggest a forum that may help: https://www.lawanswers.com.au/catego...gal-forums.21/

I have never used the forum so I cannot tell you how good or bad it is.
