  • Voluntary redundancy refusal

    Hi everyone,
I need an advice on an issue at work. Situation description:
A company with 50-100 employees on two shifts, day and afternoon (with a shift allowance) based in the UK. The company have announced a closing down of the entire afternoon shift with approx 12 men and also a reduction of 6 people. The announcement letter states that the senior management would like to sort this out by voluntary redundancies and if this will not be achieved then compulsory redundancies will be necessary. Three men including me came forward and asked to be made voluntarily redundant because we cannot work from various reasons (family, personal, financial, etc) on the day shift. However, a senior management official have approached us and told us that the company might not accept our voluntary redundancy because they don't want us to leave but in translation we have been told that we would cost the company (multinational, net sales around 300 millions euros a year with branches and manufactures all over the world inclunding China, India, Canada, ..) much money (currently on minimum wage) and if we cannot work on the day shift then they will accept our resignations (they don't want us to leave??). I would like to know if this is legal because they force us to quit without any reward (redundancy payment) just because they want to save money and get rid of someone else (we understand from any shift not just the afternoon one) who doesn't want to leave but is unlucky to be with the company for a short time. All three of us have been with the company over 8 years with an outstanding disciplinary, attendence, skills, knowledge, etc record (according to the management official).
I would be grateful for any advice on this. Many thanks Joe
