    I am seeking some advice on behalf of a friend, who was asked about two years ago to stand in temporarily as a shift supervisor, he was happy enough to do this as it brought him off the night shift which he didnt enjoy. However the stress of the job has been getting to him a lot in the last while and is affecting him in many ways including his personal life, he spoke to the manager last week asking to stand down from supervising and was told that if he did that he would be put onto a zero hour contract. There is no way he can go zero hour as he has financial commitments so he is being forced to do a job which is affecting his health badly ( he has been very down lately and drinks a lot more than he ever has ). Does he have any options?

    Yes he does.........
    If your friend has been there for more than two years (even a day more) he has protection from the employment tribunal, if the company change his contract, or dismiss him.
    Tell your friend to check his contract of employment. A company cannot alter the contract unless both parties agree.
    All employees have an employment contract with their employer. A contract is an agreement that sets out an employee’s:
    • employment conditions
    • rights
    • responsibilities
    • duties

    These are called the ‘terms’ of the contract.
    Employees and employers must stick to a contract until it ends (eg by an employer or employee giving notice or an employee being dismissed) or until the terms are changed (usually by agreement between the employee and employer).
    As soon as someone accepts a job offer they have a contract with their employer. An employment contract doesn’t have to be written down.
    Get your friend to look at the link below and it will explain everything about a contract of employment.
    Basically.........

    Employers

    You must get an employee’s agreement if you want to make changes to their contract.
    You should:
    • consult or negotiate with employees or their representatives (eg from a trade union or staff association)
    • explain the reasons for changes
    • listen to alternative ideas from employees

    You may also want to talk with workers, asking them about their future plans. With older employees this can include talking about their thoughts on retirement and their options for staying in the job, eg changes to their role, hours or working pattern.

      I will pass this information on but I doubt he will do anything about it, the manager is very confrontational and aggressive and my friend isnt Thanks for the info tho

        Your friend really should stand up to the manager, otherwise he/she will only keep on taking advantage.......
