    Hi

    I recently tendered my resignation on 28/7/2014. My contract states:

    "You are entitled to receive 3 months notice of termination. You are required to give the Company 3 months notice of termination."

    I received a letter from the company stating my finish date would be 17/10/2014. When I queried this i was told my notice period was 12 weeks. I'm assuming that 3 months would take me to 28/10/2014. Can 3 months be calculated as 12 weeks, and if so would a finish date of 17/10/2014 be correct?

    If the agreement in your contract states three months, then it should be three months, not 12 weeks.
    If the company are insisting 12 weeks, point out to them that, that is not what is stated in your contract of employment.
    Also they would be in breach of your contract.

    However, if both sides agree, then the terms in a contract can be altered.
    It really is up to you.
