    I work for a Local Authority who operate a "task and finish" policy. Once the required work is done men go home, Often this is an or two before before their 7 and 1/2 hours have been completed. We have a contract for a 37 and 1\2 hour week.

    Recently a guy worked over his 7 and 1/2 hours by one hour and asked if he would be paid overtime rate for that 1 hour, which in our contracts' is time and a half. He was told no because he regularly goes home *before* his hours so it balances out.

    Can an employer do this legally ?

    I would hope so if he gets so much pay for going home whats an hour to him?

      Actually the company must pay for hours worked, unless the contract of employment states otherwise.
      But in this case, although he could ask for his hour pay, and quote employment laws.
      he would be rather foolish to do so.
      The company may very well insist that he complete his contractual hours.
      So it's a case of 'Swings & Roundabouts'.
