  • group stalking

unsure of which forum this should be under.
What are the laws on Group Stalking in UK?
As there are more than one person, how does one accrue evidence (current stalking laws state that stalking by one person two times, however what if a different person is used for each occasion?).
Secondly, what if the stalkers are photographing the person on a continual basis?
Thirdly should the victim then photograph these people whilst they are photographing the victim?

I would regard this situation as two offences:
    1) Stalking
    2) Conspiracy or assisting an offence.
Serious Crime Act 2007, & criminal Law Act 1977 possibly apply.
Perhaps you should take advice from a criminal lawyer or the police.

Consider using the Protection from Harassment Act 1997. This offers both criminal and civil routes.

Two or more people may pursue a collective course of conduct and be equally guilty. (this closes the loophole which allowed several people to each commit one act of harassment).

s7(3A) A person’s conduct on any occasion shall be taken, if aided and abetted, counselled or procured by another
        (a) to be the conduct on that occasion of the other (as well as the conduct of the person whose conduct it is); and
        (b) to be conduct in relation to which the other’s knowledge and purpose, and what he ought to have known, are the same as they were in relation to what was contemplated or resonably foreseeable at the time of the aiding, abetting, counselling or procuring.

You are perfectly entitled to gather evidence of crime. In a Harassment case, nothing beats video evidence.

The problem with taking photographs is, unless you have absolute proof of stalking, then it is perfectly legal to take photographs in a public place.
