  • Fulfilment of Minimum 20 Hours in a Contract-

    My girlfriend's contract of employment states a minimum of 20 hours per week. They are currently only providing her with work for 12-15 hours which she is logging and being paid for...is she within her rights to demand the difference? She feels that she is being constructively dismissed and keeping a log of all abuses but in the meantime she wants to make a point about the minimum hours not being met.

    Hours Stated in Your Contract of Employment.

    The first thing to look at is the number of working hours stated in your contract. This is the number of hours that you are expected to work. Your employer must give you at least that number of hours. Your employer only has to give you the minimum number stated on your contract.

      Thanks. The contract states clearly a minimum of 20 hours and she is not being given the hours. Many thanks. I assume then an approach for payment of the missing hours over the last few weeks would not be inappropriate?

        Certainly wouldn't.....
        One thing though,
        Try a gentle approach with management.
        Just say that you are finding it extremely difficult to manage on the cut hours.
        Remind them that you are contracted for 20 hours, and believe that the company are obligated under the contract of employment, to pay that amount.
        Request back pay for the hours not paid to you.
        If need be, put it in writing and make sure you keep a copy.... Dated of course, and with the name of the person you are dealing with.
