  • Temp Contract - Being Replaced

    Hello all,

    I have no idea if what my employer is doing is legal or not. It very well may be, but I thought I'd make sure.

    I'll give you all the details. I started at the company in April 2011 then in March 2012 after 2 6-month contracts I was let go as work had died down.
    I was then employed elsewhere until I saw a job at that company again, so I went for it, got the job. So from October 2012 I've been back there on a 6 month contract, followed by another 6 month contract, followed by several 3 and 1 month contracts.

    I was told last month that they didn't want to keep me on because I wasn't a "right fit" for the business. I was told there was nothing wrong with the work that I was doing, I just lacked the drive and motivation to be part of the team, despite the fact that during this time I've put in over 200 hours of unpaid overtime and worked a 12 hour day. My job is now being filled by someone, so they're not making the job redundant, they just don't want me.

    I realise they may be in their rights as, while I have worked there for 2 years and 9 months, I have only been there 1 year and 9 months this time round. I was just wondering if they could get rid of me and replace me like that without any sort of real reason. I also do a little bit of IT there on the side, and they realise that's what I really want to do, but I was told that no IT was required at that site. But could I please install 40 new PC's :caked:.

    Unfortunately my friend, you made a break from the firm.
    To claim unfair dismissal you need to have worked continuously for two years for your employer.
    On or after 6 April 2012 - the qualifying period is normally 2 years
