  • Gross Misconduct disciplinary. Advice needed.

    Hi. New here and not totally clued up on these kind of matters so I am hoping for some advice. If I say too much and detail it could be picked up and used against me so apologies in advance for rather scant information. PM me if you can help so I can go into more detail, but basically I am up for a disciplinary after an investigation for drink related allegations. Over 20 colleagues went to the pub during "downtime" (that is all I can say without going into detail) but I was the only one who was targeted after having alcohol smelt on my breath ( consumption was 2 pints over a 3 hour period in effect) and was taken into a documented discussion in the first instance. This was then picked up by a higher manager and taken to investigation, which summarily came to conclusion that it was deemed Gross Misconduct pending a disciplinary. It seems, however, that I was not so unfit to work in their mind (and mine) as to send me home and I have not been suspended and continue to work in the same capacity. Initially I did not give names of others, but later decided to do so as I thought this was a possible case of victimisation and really thought it unfair to target just one individual and overlook the others.

    So, any help with this would be great. It would probably be best to go private message with this. Thank you in advance.

    this appears to be a typical case where you might do well to seek the advice of a Union rep, find out who represents your particular area of work and even join the union immediately then you could get free legal advice from the union solicitors over the telephone.

      Thanks for the reply. Yes I am already actively seeking union advice but wondered if there was anything anyone could add or may have had similar experiences and their outcomes.

        Are you aware of any reason why your employer might want to single you out?
        Nothing I say should be taken as qualified expert advice. I am not an expert in anything.

        If you decide to act on anything I have posted you agree not to hold me liable in any way.

        If you are unsure then you need to take proper advice from someone who is an expert.

          One of the main points here is if you were getting paid on 'downtime.' If so you could be in trouble. However all is not lost check out this URL. Company policies can be worded incorrectly and one policy statement can contradict another.
