  • Falsely Accused in the Workplace.

    Hi,

I'm a first time poster so hello to all - I have a genuine need for some advice please...

We had a new team member start about 10 weeks ago, and everything with this individual seem to be going okay until a fortnight ago. This person went sick on Wednesday, came in Thursday for half a day then went home and was then off on the Friday. I was on holiday all of last week and when I got back to work on the Monday I found out that this person had been off all that week too.

It turns out that they had resigned last Thursday and then sent an email to the senior manager citing a number of unacceptable behaviours which this person claims led to them resigning. This individual was interviewed on Monday so that the senior manager/HR could understand the allegations. During the interview a number a specific issues were cited against me and a small amount of information was provided although in some cases there was no supporting information or the context of the original email was repositioned.

When I got to work on Tuesday morning my senior manager asked to have an 'informal meeting' with me in order to make me aware of the chain of events and to make me aware of the primary allegations.

I was then presented with the a copy of the email, but only the pertinent part that was directly citing me. This was copied into a 'Counselling Form' giving an overview of the reason for discussion. The counselling form cited various things such as name calling, religious and mental health mickey taking (for want of a better phrase - apologies), and making general harmful comments at his expense.

Once I read through it, my senior manager then gave me the opportunity to respond and they took notes. Later on that day I was given a copy of the counselling form with the notes added for me to read, make any adjustments if necessary, sign and then hand back. I have been given a copy.

I have been told that this counselling form will go on my personnel record - when I asked why, I was told that it was to protect me.
A concern I have is around this document going into my personnel file. The scenario I was thinking was.....if both my line manager and senior manager were to leave the business and then at some point I decided to move on within the same company for example, then any new people looking at my file would come across this document and not know the complete background and possibly make up their own mind about me as a person purely based on the false accusations levelled at me in the document.

As I say, this individual has resigned already.....but upon reading the allegations in the meeting on Tuesday, I had an anxiety attack...my throat went dry, my heart rate was thumping like mad. I have a condition call GERD.....it comes and goes in waves. I can be fine for weeks or even months at a time but when it comes on it is very uncomfortable and means I don't get much sleep. Tuesday night and last night were horrendous, getting about 2 hours sleep across both nights.....I genuinely believe that this episode has come about as result of these false accusations.

Do I have any course of action even though this person no longer works for the company? Or...I am best to just put it behind me and move on with my life?

Any and all help/assistance/advice is most welcome - many thanks in advance.

    Regards,
