  • TUPE measure implications

    Sorry but another TUPE question.

    I have recently been transfered from one local authority to another. In the letter sent prior to transfer one of the measures the the new employer proposed post transfer was to look at rotas.

    It now emerges 2 months later they actually want to change a contractual working day of 7:24hrs 5 days a week to one of 9:25 four days and swap the flexible working policy with core hours. I'm a Union member but rep is not available at moment. but I know none of this as been agreed

    The HR department are saying that as these are "measures" declared pre-transfer and there were no objections before transfer, the TUPE restrictions on changes to t&c's of contracts does not apply and they can just impose them.

    Can't believe this is true but then again I'm certainly no expert.
