    Hello All

    I am new to the site and seeking some advice..

    I am a civil servant and have a flexible working contract, I have been asked to undertake over-time within my core working hours. Is this legal? I don't want to agree to do this and then find that HR will not pay me or that there may be legal ramifications (e,g fraud).

    Any advice much appreciated and gratefully received.

    Could you expand a little more, difficult to know how to answer.

    In what way do consider it could be fraud and does your contract allow for additional hours.

    Do you mean that the hours you would normally be working at regular pay being billed at overtime rate?

      Have to agree with Tools, we need more info. From what you have said so far, they want you to work overtime within your core working hours, but not pay you extra for the overtime. If the hours are within your core working hours then its not overtime, as you'd be working your core standard hours. So its sounds like your not working your full core hours and they are wanting you too work up to your core hours. That's why your question is a bit confusing.

      Though it sounds to me, that because your working flexible hours, your working less than your core hours and they are wanting you to work your full core hours - If that is the case, then your not eligible for overtime pay, as they are still your standard hours - Its the effect it will have on your flexible working time that should be more of a concern. As no doubt you work flexible hours for family related reasons.
