  • Changes to flexible working request

I have been working under flexible hours for 6 years with my current employer but problems started when I returned to work after my 2nd child last July. My employer has been badgering myself and the other flexible workers to work Sundays. I have repeatedly explained I am unable to work weekends due to my husband works Saturdays and most Sundays. I recently got a letter stating I will be required to work Sundays. I replied with my availability and explained my problems to get Childcare over weekends but my request was ignored and I've been issued a letter stating I must work 1 in 4 Saturdays. I had a meeting with my union rep and he stated due to the law change in June I must work this and if I refuse then the company can end my employment. Please can anyone help

Re: Changes to flexible working request

Any changes to your working patterns must be mutually agreed between the employer and employee.

If you are unable/unwilling to agree to their request then yes, they are able to dismiss you but must do so following correct procedure. Depending on how long you have worked there you may also be able to claim constructive dismissal but would have to go through an employment tribunal. What Union do you belong to?
