  • Probation Period Sickness, Advice Needed

Hi I wonder if someone in Employment Law could advise me

My wife underwent surgery on her spine, during her recovery she looked around for a new job and found a new position. She was fully open and honest with them at interview regarding her surgery and didn't hold back any information they requested. She was signed off by her surgeon to return to work and started her new job shortly after on a 12 week probation period. 8 Weeks into her job she developed chronic pain in her neck and arms and was signed of by her GP, she has been under review by her surgeon and if on high doses of pain relief including morphine. She has had xrays and MRI scans to investigate and is scheduled to have a cervical epidural injections within the next few weeks. Her surgeon is advising her with the intent for her to return to work approx six weeks after the injections. She is in receipt of statuary sick pay plus her car allowance(at present), she has been informed (not yet officially)that her employer wish to terminate her employment because of her not yet completing her probation period.
    Can they do this?
    What rights does she has?

    Thanks
