  • Change of Notice Period in Contract

I've been empolyed at my current company for over 10 years, and they are now introducing new contracts to the whole company.

Most of the changes are just housekeeping, but there is one I am concerned about, the Notice Period. My current contract is very favourable in my benefit. I have to give 1 months notice, but they have to give me 12 weeks. The change would mean that I would also have to give 12 weeks notice. There is a clause in the existing contract that states 'The Company reserves the right to make reasonable changes to the terms and conditions of the employment.'

I'm really not keen to sign up to this as in my previous job I was on 3 months notice, and it severly hampered me getting another job.

A bit of reasearch has shown that I can protest at this, and not sign it, but it then sounds like everything could get serious. I have a good relationship with the company, but I'm not sure how far I can push it. They are fairly small, about 100 people.

Does this change constitute a 'reasonable change' and therefore they can do it without my consent?

Another factor is that they are just about to issue some share options, and I presume that they can withhold these until I comply with the new contract?

Any advise would be gratefully received.

Thanks. I wouldn't have thought they would go to the extremes of firing & rehiring, and I'm not likely to take them to court for breach of contract.

I guess I have two options
      1. Negotiate for a compromise, e.g. 6 weeks notice, or an extra pay rise
      2. Make them understand I'm working under protest, and see what happens if I do decide to hand in my notice.

Any comments about the 'reasonable changes' statement in the contract, or is that standard. What is 'reasonable' seems very loose

How is it worded in your contract?

As 'The Company reserves the right to make reasonable changes to the terms and conditions of the employment.'
