  • Advice regarding Sickness Absence/Pay

    I wonder if anyone could help interpret what sickness absence pay I might expect.

    This is the relevant clause:

    "During the first year of service - full pay for 25 working days and after completing four calendar months’ service, half pay for 50 working days"

    I work 4 days a work (0.8 FTE) and I had expected the 25 working days full-pay to be pro-rata but it wasn't. I received full-pay in Feb.

    Accident on evening of 21/01/2014 resulting in being signed off work by hospital from 22 January until 28 March - multiple fractures.

    So I am now assuming I will receive SSP for March BUT whilst being off-sick I have completed the 4 months service referred to for half-pay. Is this relevant? Or will I just receive SSP as I went off sick prior to having completed 4 months service?

    Well i have to admit they are some what vague, as working day could be defined as days you would have worked, or days of week your employer trades. I would say it would be 25 days of days you would have otherwise worked had it not been for your accident. From how many days have you been paid for since your accident (up to end of feb)? Are you monthly pay, weekly pay, and did you work month/week in hand?

    Personally i would speak to HR informally about the dependency as it may be a simple mistake on their part, which we won't know for sure till you have asked them about it, pointing out it says the first 25 working days will be full pay.

    As for the accident itself, did this occur at work? If so, was it recorded in the accident book? Was HSE informed so they can investigate? Have you started a personal injury claim?

    What was your start date for employment?

      I work 4 full days a week. Employer trades Monday to Friday only. Paid monthly (mostly) in arrears (pay day just before the end of the month). Received full-pay for January and February. I would have expected full-pay for January as (a) well within the 25 days whether pro-rata or not and (b) salary cut off would have passed anyway. I didn't know what to expect for Feb but received full pay. Thought might have had a couple of days of either SSP or half-pay but then if it's 25 days (regardless of whether you are part-time or full-time) then that takes me a couple of days into March.

      No, accident wasn't at work. Slipped on ice outside a shop. So not sure claiming for personal injury is viable!

      Started work last week in October - hence the 4 months query. Went "off sick" prior to having completed 4 months service but have now done so (February).

      Not sure if any of that is any help?

        Ok sounds like they are paying you for 25 days that you would have otherwise worked. I would assume that the extra 50 days applies only if you had worked 4 months prior to sickness to be honest. Best call them to ask, that way you will know what to expect and can put money aside to cover any bills for the month.

        So i would expect your pay for March to be half pay per days (plus 2 days full pay you mentioned) that you would have been at work. So looks like they are sticking to what is in the contract.

          Thanks for your help. I would expect them to stick to contractual terms - barely been there 5 minutes! I'll give them a call and see what they say. Am hoping to be back before the end of the month anyway but depends on how physio goes so not counting on it.
