I have worked for a global construction and facilities management company now for about two and a half years. On starting I signed a zero hour contract and was told all the usual fodder about growing people and progressing them from inside rather then taking in 'outsiders'.
I know for a fact that within another department on site that if a zero hour member of staff passes probation they are given a contract with an hourly value (20/32/39.5).
During this employment I have gone for six different jobs advertised both internally and externally and am always told I interviewed well (sometimes perfect) however I was not the right person for the job, even though I had previous experience in that field or the required skills to do the job well.
When I have spoken with management about my performance and career opportunities (or lack of as the case seems to be) I am always told that I excel in everything that I do and that nearly all of the positive guest feedback the department I work for receives is as a direct result from me, that I am a key member of the team and the team would suffer if I were to leave.
My two questions are:
Is there any law that states a time period on zero hour contracts and how long a member of staff can remain on this contract?
and
I have heard of and understand constructive dismissal but is there such a thing as constructive job blocking?
At this moment in time I feel I'm being kept in one place to ensure the standards and guest feedback is kept to a high when in all honesty the job now bores me due to lack of me feeling under valued and going no where fast.
Any advice on this would be appreciated.
