  • Unfair redundancy - not being offered any alternative positions when they are advert

    Hi All.

My other half has just been told she is being made redundant, however I don't think the company are going about it correctly so wondered if somebody might be able to help. Basically what is seems to boil down to is there is a personality clash between a new recruit (brought in at high level to restructure) and her. She has slowly had her work taken away from her and distributed to other people and has now been told her role is no longer needed. They are advertising for new people in a role that my girlfriend can do and has worked as in the past, so really they should be offering that as an alternative I think, but that is not happening. Also in her personal development meetings for the last year and a half she has told her company how she wants to be developed to move forward and has been given no support in doing so, which if she had been given she would not be in this position. We knew something was happening as all of a sudden everybody stopped replying to her emails and no answering her calls or texts.

Any advise what to do would be grateful.
    Thanks

Has your girlfriend expressed an interest in the advertised role to her employer?

If she were to be considered for the role it may be possible for her to continue working there under a variation of contract, this way she will not loose any rights accrued under her old contract (holidays etc).

Yes, basically they are recruiting senior consultants which before joining the company was her role. In her development meetings for the past year she has told them she wants to move back into a senior consultant role (she is a client engagement lead at the moment) which they have been indicating would be a good move but then haven't supported her to do so.

Also in every meeting and every conversation about her and her work that she has ever said she has had nothing but praise. Two months ago she was told she needs to start attending the Director meetings to be developed into a the senior management team, and now this.

I think your other half should give Acas a call to check on her rights and her employers obligations before doing anything further - Acas Helpline 08457 474747

How long has she worked for this company ?

Been the for almost 3 years. I was going to suggest ringing Acas but having read a few other posts on here it seems there advice is not always the best so I thought I would ask the collective first. Do you think they are going about this the wrong way?

Re: Unfair redundancy - not being offered any alternative positions when they are adv

If other positions are available in the company, then they are obliged to offer those positions to those who's roles are being made redundant.

How many people are being made redundant by the way?

Or is it judt your better half thats being made redundant?

Is there any one with same or similar role in the company as your other half? Have they been told their position maybe subject to redundancy as well or not?

If its just your other half being made redundant and no one in same or similar role has been consulted that their role maybe subject to redundancy also, and no alternative position that is available in the company has been offered - Then it would be deemed unfair dismissal.
