  • TUPE issue!

    Hello,

    I have a slight issue with my employer who wants to change the time I start and end my working day but I believe I am protected under TUPE law and would like some advice.

    I started work for a company in September 2011 which was contracted to another company. I was employed for 15 hours a week, which was then reduced to 13 and half hours. In September 2012 the contract was not renewed and I was TUPE'd to my existing company and my hours were increased to 14 and half hours. All the time my start time has been 7am working 5 days from 7. This has fitted excellently with my Degree course. Now, we are having a change in management and the incoming manager does not want to start so early so is attempting to get me to start at 8:30 each day with the possibilty of working 6 or 7 days a week to make up for any loss of hours.


    I feel this will not work alongside my current commitments and would like advice on whether this was possible or am I still protected to the same conditions I had with my previous employer?


    I hope this makes sense and I will attempt to clarify any points on request.

      On top of what Tools has provided, just thought i would point out that this is not actually a TUPE issue. Your current employer is simply wanting to vary the terms of your contract with them.
