  • My employer does not want to pay me

    Hello all,
    I have worked since beginning of december for the oil Company X through the employment agency, let's call it Company Y. The problem is that the agency I worked for went into bankruptcy in the beginning of january and they are not able to pay me the money that they owed me since the end of december. Three weeks ago, I went to ask Company X about the money but they said that Company Y was not solvent anymore, and the company X would pay me the money outstanding as soon as possible. They promised to get my money settled the week after which was 2 weeks ago. I keep asking Company X for the money every week but they keep telling me that they can't do nothing. I am fed up waiting. Could anyone help me with my problem please. Is there any legal way I could take to resolve this? Is it possible to hire a lawyer to speed up things?

    You need to contact the administrator for Company Y and notify them of the wages you are owed, they will then list you as a creditor - Though whether you get anything or not, depends on what is left after the main creditors are paid. Company Y is not liable for your wages as generally companies pay this to the agency who then pay it to you.

      Do not waste any money on a solicitor, Company X does not owe you any money, they owe it to Company Y and will be chased for this by whoever is dealing with the administration
      Even when Company X pays Company Y this does not mean that you will be paid as the adminstrator will collect all the monies due to Company Y and then distribute what is left after he has been paid his fees and expenses.

      Employees of a company can be paid some unpaid wages by the Insolvency Service, this may or may not apply to you depending upon how you worked for the agency.
      It is worth posting some more details of how the agency employed you, others on this forum may be able to advise if you are able to claim.

        I know exactly how you feel, I am having a similar problem myself. Company probably trading insolvently. I have appealed to the directors this morning to pay me.... lol I don't suppose they will but I had to try before issuing a Stat demand as they are in breach of my contract.
