As far as the human rights angle goes, the Human Rights Act 1998 and Rome Convention (aka European Convention on Human Rights), which is enshrined within the Act, applies to the acts of public authorities, commercial entities performing the function of or on behalf of a public authority or individuals performing a public function. A breach of Convention rights has to occur in order for a cause of action to exist. Convention rights are inalienable and inviolate.
