  • Change of job and Redundancy

    Hi All,

I work for a company that has been in decline for some time. I have worked there for over 10 years.

I used to work in a supervisory role, for which I have a written job description. However, about a year ago I was moved sideways to an engineering role.

I was verbally offered a small pay rise which never transpired. I was promised that "lots more work and projects" would be upcoming for me to do (I like to be busy)

However, since the move, work has been very light indeed. Jobs are being given to others within the organisation. The promised pay rise has not been forthcoming, despite asking. No revised job description has been received, despite asking.

I have heard on the grapevine that cuts to staffing are in the pipeline. Previously, long serving employees have been removed due to trumped up reasons.

My gut feeling is that I have deliberately been moved into a role with no work so that I can be got rid of. If history of previous employees is repeated they'll fight tooth and nail to avoid paying redundancy.

What are my rights to redundancy? Bear in mind that an updated job description won't be provided and I left my previous role a year ago. No contract has *ever* been received either.

    Hello Steve

Firstly - may I suggest that you change your username if it is your real name as it is visible over the internet. One never knows!

Do you have anything in writing at all from your employer - any appraisal, 1:1 notes etc? I realise that you don't have a contract.

Have you ever been given a contract throughout your ten years working for the company?

As for redundancy, the change of role does not effect your right to statutory redundancy package, which is 1 weeks pay per year - As detailed below:

      • half a week’s pay for each full year you were under 22
      • 1 week’s pay for each full year you were 22 or older, but under 41
      • 1 and half week’s pay for each full year you were 41 or older

As for the pay rise, as it was verbal and not in writing, then not much can be done regarding that unfortunately.

Well, I had a letter when I first started working. It has a job title on it which changed about two years after starting work. It has the initial starting salary and the notice period. That's it.

I recorded it on my mobile phone, purely as an aide memoir for myself so I know exactly what was agreed, but I realise that this can't be used.

I have made notes, too, of various discussions that have taken place so I know it's not my imagination. (When I raise things like promised pay rises with the boss I'm told that I "imagined" it)

In answer to other points, appraisals have taken place on a spurious basis every couple of years but I'm never allowed to have a copy of these. It has even been the case that during appraisal a list of targets has been produced that I have never seen or signed. Forms from supposed previous appraisals are produced, again unsigned. One was even supposed to have been held when I was on holiday! LOL!

My gut feeling is that the boss is trying to pull my chain so to speak and force me to leave without payment. The more I think about it the more incidents of 'corporate bullying' come to mind. However, when I tell people about things they generally say "Don't be silly! A company wouldn't do anything that underhand, surely?"
