    Good Afternoon,

    I would really appreciate some advice please.

    I've been working within the same role for the past 7 years. My salary and role was agreed 7 years ago and I've had the usual 1-2% salary increase each year. My job role has not changed in that time, in fact it has got more detailed I would say.

    18 months ago we had a new person join our team who I believe is on considerable less money than myself and my colleague who has also been here seven years.

    Our Manager, who has been managing us for only two years, has made several comments over that time that we are over paid. Yesterday my colleague and I were called into a meeting with our Manager and a member of HR. We were told that our job roles had been assessed and they believed we were in the wrong job family. They have now downgraded our job family and said we are no longer able to eligible for a salary review. Not just this year, but for at least 30 years!? We will only be eligible once our new team members salary is in line with ours. It works out that it would take around 30 years for their salary to match ours on a 1.5% per year.

    Are my employers allowed to do this? Can they select who no longer is eligible for a salary review. No one else in our area has been told they are never getting a salary review again. I feel like we have no option but to leave now. They will be sending me a new job description soon, which I know will be far more basic than the role I'm currently doing but they will still expect me to work the same role as I have been for the last seven years. Am I within my rights to refuse to carry out any tasks that are not on the new downgraded job description?

      Does your contract provide for regular salary reviews?
      If it does and your employer doesn't carry out a review in reasonable time,or without giving the matter due consideration,there could be a breach of contract.
      However a review does not necessarily mean an increase, but it certainly doesn't allow a reduction.
      As you have been told you will not be getting an increase, one can assume no review is taking place.

        Is the new Team member employed to carry out the same duties/role as you and your other colleague?

        I would be careful of accepting a downgraded position, you may find that particular position becomes defunct quite soon, a sneaky way of getting rid of you and then creating another two positions at your current position, but at the lower rate of pay.

        You would of course be invited to apply for those positions, but at the reduced rate.

        They have a duty to treat each person fairly and equally to anyone else in that same role. If they are removing reviews for just you two, they must do the same for everyone doing the same role, otherwise this is classed as bullying/harassment/victimisation.
