Hi folks
In my job i work a 3 shift pattern, days, afternoons and nights. We work 4 night shift pattern and 5 for the other 2 shifts. As we only work 32 hours on the night shift, we make those hours up on the other 2 shifts so in total we work 112.5 over 3 weeks = 37.5 hours.
I am salary paid and we have always taken 4 days holiday for the night shift. Now they are trying to impose new terms by making us take 5 days holiday for a full week on nights, for no other reason that we are in work friday morning so thats 5 days.
our argument is that he cant make us take 5 days holiday as we have already made the hours up on the previous 2 shifts. we would be losing 1 days holiday (7.5) and 5 hours from the other shifts.
they wont budge on this but i need to know if there is anything from an employment law side that is in black and white that may help me?
