Hi there, I have only just noticed (by checking my online banking) that my employer hasn't paid me on 5 occasions (possibly more), as I work at a football stadium I only work on a match day when the team plays at home, therefore my working pattern is un-regular, not only have I not been paid dating back to October 14th, I have also been underpaid for an unknown reason. Now the company I work for, a catering company has underpaid before and I believe I overheard a fellow employee say they had also been underpaid, I don't believe I have a contract with them, and as there are so many people at this company everyone passes off any responsibility, and declares it doesn't concern them. I'm still awaiting on any paychecks since restarting the football league season,which started in September, which I've been told I must go and collect myself, but as I've seen my statement I know I've not been paid, and have been underpaid, it's difficult for me to know who to contact it being such a large company, however I don't want them to get away with it either, my pay is very poor as it is, any help would be appreciated

Hi Domenica.
First you need to send a letter to your employer stating the dates you have not been paid for and what amounts you have been underpaid for the dates you were not paid in full. Point out to them in the letter, that it is a breach of section 13 of the employments rights act 1996 to withhold wages without employees consent which you had not given. Contacting the football club themselves asking for details as to whom you need to talk to should be enough for them to give you the name and address to send your letter too.
As for your contract, YES you do have a contract with them even if its just a verbal agreement to work for them, once they offered you the work either verbally or in writing a contract then existed when you agreed to do the work. Its also a breach of the employment rights act 1996 for them to fail to provide you written particulars of your contract within the first 2 months of your employment with them starting. So it would be worthwhile asking for your written particulars of contract in the same letter.Please note that this advice is given informally, without liability and without prejudice. As this relates to unpaid wages, it is a 'breach of contract' claim which can be actioned via the county court 'small claims' procedure, (or initiated online via ' Money Claim Online ')CAVEAT LECTOR
