  • Return from work after maternity and not wanted

    Hi all

I will try and give a brief overview..

I work from home as a project manager in IT and have done for years
in 2012 i was given a 2 step promotion to team lead with pay rise to then go to team manager with pay rise in Q4 2012 and my email confirmation from my manager confirmed the manager position would take place when I took over HR responsibilities for the team

I went on maternity leave, came back, took on all HR responsibilities for the team but did not get title or payrise as i was going on maternity again and I expected it on my second return. I hired, fired, promoted, appraised the team and did the managers role for 6 months before i left for maternity

Towards the end of the second maternity i got an email from my manager saying the role i had been promised (but actually was already doing) had changed and become bigger, now instead of a team of 5 it would be managing more people from more countries (i am EMEA based and my whole team is split throughout EMEA). He stated that role could no longer be done from home. I argued this with him as the role was already mine.. I said had i not been on maternity leave i would have had the payrise and title and he said "probably but these things happen".. he then tells me i can remain as team lead or come back as project manager and continue to work from home

2 weeks before i return to work i get another email saying i cannot have the manager job, when he employs a manager my team lead role wont be needed and i cannot do the pm job from home (even though i have for years)..

I am back at work this week and had a meeting with him where it is clear he has made his mind up that I am gone, he will not clarify my position only to say I am team lead and when he hires a manager i wont be needed..

    What should i do??

Re: Return from work after maternity and not wanted

When you say hes saying you will be gone, do you mean he is making your redundant, or firing you?

Also what type of employment contract are you on, are you employed full time or self employed etc?

        Hi tiggerjr82,

This may be useful to you.

        Commission tackles pregnancy discrimination

        04 November 2013
The Equality and Human Rights Commission will be undertaking a new comprehensive research project into the scale of pregnancy and maternity discrimination in the workplace.
Anecdotal evidence suggests that some pregnant women experience discrimination while on maternity leave or on their return to work. However, there is no up to date evidence as the most recent data goes back to 2005.
The project will investigate employers’ practices towards employees who are pregnant or on maternity leave, and these employee's experiences in the workplace to provide evidence on the extent, causes and effects of pregnancy and maternity discrimination. This information will enable the Commission and Government to shape the most appropriate response.
The Commission proposed the project to the Department for Culture Media and Sport (DCMS) as part of a package of measures to address Equality and Human Rights, and Secretary of state Maria Miller has confirmed the funding to support this project.
Education for both employers and employees nationally will be key to tackling this issue and the Commission will assess how best to raise awareness of pregnancy and maternity rights.
Mark Hammond, Chief Executive of the Equality and Human Rights Commission, said:
'It is very concerning that in 2013 a number of women are still being disadvantaged in the workplace just because they are pregnant. That would be unlawful discrimination and needs to be tackled.'
'We will look at existing research, gather new evidence and carry out our expert analysis to establish the extent of the problem and advise on how best it can to be addressed.'
        -Ends-
For more press information contact the Commission's media office on 0161 829 8102, out of hours 07767 272 818.
        Notes to Editors

The Commission is a statutory body established under the Equality Act 2006, which took over the responsibilities of Commission for Racial Equality, Disability Rights Commission and Equal Opportunities Commission. It is the independent advocate for equality and human rights in Britain. It aims to reduce inequality, eliminate discrimination, strengthen good relations between people, and promote and protect human rights. The Commission enforces equality legislation on age, disability, gender, race, religion or belief, sexual orientation or transgender status, and encourages compliance with the Human Rights Act. It also gives advice and guidance to businesses, the voluntary and public sectors, and to individuals.
