  • Newbie! help with disciplinary over time of for dependant please!

    Morning all,

Some help required from a newbie!

I have worked for the same company for 2.5 years now, and last year had 5 separate days off (emergency time) for my baby, who had an awful year of health problems, 2 of those days where hospital admissions. The manager at the time was very supportive, and never raised any concerns. She left the company in November 2012.

Since February we have had a new manager. She called me in to discuss these absences, and I explained the reason. She was not happy at all and told me if it happened again I would be disciplined. In July I caught a gastrobug in work and was off work for two days. There where also several other staff off with the same bug.

I received a letter on Friday to summon me to a disciplinary hearing for the dates in july, with the 'sickness' report for the 5 days last year attached.

Can anyone help me? I have informed my union, and they are going to advise me on Monday. My concerns are that it obviously wasn't me who was sick, my child was very ill last year. I have also been offered a new job and I am concerned this could have the offer withdrawn.

    Very stressed out mummy here!!

Thank you so much in advance

(ps- please forgive the spelling mistakes, I'm on nightduty and sleepy!

Hi Steph, & welcome to Legal Beagles.

Your new manager clearly needs some training in this area of employment rights.

Of course you have a right to a reasonable amount of time off to look after sick dependents, especially children.

Please have a read of the ACAS & Gov.UK links below.

Thanks so.much for your early replies.

I've looked at all the info I can get, it seems there is no right answer. I can't understand this disciplinary meeting if she can't discipline me for the child being sick.

I however am scared as to whst she's going to say, I've only ever had one informal discuss with her about this And I thought we had left it at that

In the letter requesting you to attend, does it specifically state 'disciplinary'?

Also, does it state your right to be accompanied by an appropriate companion/union rep?

Evening, sorry for late reply, sleeping, and working again tonight!

The date of the disciplinary is this Thursday, the dates noted on it was a date n july I was off for 2 nights due to a gastrobug caught in work, which they know.

does this help? I'm so stressed about this all.
