Thank you. Sorry for the questions I just wanted to work out the circumstances the recording was made.
I'm no expert but I believe there is nothing unlawful about recording a conversation if you are a part of it, however consent should be obtained before passing the recording to a third party....apparently unless it is in the public interest (I'm not sure if disclosing it to your employer counts as in the public interest I guess it depends what you were saying) I don't think the references posted earlier count for a personal conversation (ie not a work meeting etc)
Was the conversation between colleagues at work, or in your own time down the pub etc ? Without going into too much detail were the derogatory comments just normal ' boss is being a tosser ' stuff or a bit more serious? ie. should the OP have received a warning or could it be classed as gross misconduct.
