  • I resigned ONE day before my department was made redundant - do I have any recourse?

    Sorry if this isn't the right place to post - I wasn't really sure where to go with this, but any help would be appreciated! For reference, I am in London, UK.

    Basically the day before I went on holiday, I handed in my resignation to my manager. The next day I'm inundated with texts and messages from my co-workers, telling me that we'd all been made redundant. Meaning I'm now missing out on sweet, sweet redundancy!

    I'm pretty sure there's no way out of this, however I only got confirmation from HR regarding my resignation today... almost a week after I gave it to my boss and after the company-wide meeting in which the announcement was made. I'm wondering if my boss only just now told them, as she's had a lot on her mind.

    So here's the angle I'm coming from... if HR was told of my resignation AFTER they announced redundancy, can I argue that technically I was still made redundant? Or can I claim that since I only got confirmation today, my resignation wasn't binding at the time, so I was made redundant with everyone else?

    If you have any suggestions or ideas of how I might approach the situation, I'd be really appreciative!

      I didn't date it, however my resignation was via email, so they'll be able to see the date

      But I'm hoping that, if my boss forwarded my email to HR after the announcement, that I can argue since she was late in handing it in (since I was on holiday all of this time) and since redundancy had already been announced, that I was made redundant with everyone else.

      Yes I know, its a long shot!! >_<

          I think you may be out of luck. You would need to see the terms of redundancy as it may also state you have to work until at least xx/yy/2013 and if you leave before then you would forfeit any entitlement.

            i wouldnt be able to claim statutory redundancy pay as i haven't been at the company for 2 years, but they're paying everyone who was made redundant through the month of October... so that would have been an extra month of pay !
