  • Hours worked rounding issue

    Hello everyone. I've been searching around and no one seems to have an answer to this question, so any help would be great.

    My employer (a large retail company) rounds all of its hourly worked employees pay. However it is always in favour of the company. We get paid to the nearest minute at all times (breaks and overtime) however when staying late if we clock out 10 minutes or under late it gets rounded back down to the time we should have finished. However if we are 11 minutes late leaving we are paid for the extra 11 minutes and this is not rounded up in the same way.

    So if one day I clocked in at 9:58 and then left at 19:40 I would only be paid from 10:00 to 19:30. And if I worked from 10:00 to 19:41 the I would be paid for the full amount.

    It seems in the US there are state laws that mean rounding should either be fair or in the favour of the employee. I know this might seem petty, arguing over the odd minutes but when your not earning a lot (yay retail) it does all add up to quite a lot.

    Hi ******h517, & welcome to Legal Beagles.

    I've seen instances where 'rounding' has been calculated to the nearest day, or even half day.

    But not minutes.

    If you're stressed by it, why not put in a 'Grievance'?

      Its not really rounding though. it only ever rounds down, in the companies favor.

      I do plan on writing to the company, though it would be nice to know whether or not they are even allowed to do this before I make myself look stupid.

      Thumbs up for the quick reply (Y) wasn't expecting much until Monday :P

          Be very careful when approaching your employer about this, you have to remember that we are 'allegedly' in times of austerity and some companies will not view this kind of approach kindly, and if they are looking to lighten the workforce load then you could be putting yourself in the firing line.
          What you could do is ask what the company policy is regarding the rounding and leave it at that for the time being.
          Oh and before you ask, yes I am an employer.
