Hello everyone. I've been searching around and no one seems to have an answer to this question, so any help would be great.
My employer (a large retail company) rounds all of its hourly worked employees pay. However it is always in favour of the company. We get paid to the nearest minute at all times (breaks and overtime) however when staying late if we clock out 10 minutes or under late it gets rounded back down to the time we should have finished. However if we are 11 minutes late leaving we are paid for the extra 11 minutes and this is not rounded up in the same way.
So if one day I clocked in at 9:58 and then left at 19:40 I would only be paid from 10:00 to 19:30. And if I worked from 10:00 to 19:41 the I would be paid for the full amount.
It seems in the US there are state laws that mean rounding should either be fair or in the favour of the employee. I know this might seem petty, arguing over the odd minutes but when your not earning a lot (yay retail) it does all add up to quite a lot.
