  • Made redundant but 3 months pay due - I am trying everything!!

    Hi Everyone

Wondering if anyone can help as I have hit a bit of a wall....

On 16th April 2013 - a letter for possible redundancy
3rd May 2013 - Second letter stating that my role had been made redundant and that I had been placed on gardening leave until June 28th 2013. This letter confirmed that I would remain an employee of the company and that I would be paid my monthly salary and any untaken holiday accrued. Never received payment for April, May or June salaries so submitted a claim to the Employment Tribunal.
21st June 2013 - Received my notice of claim from the Employment tribunals - notice of hearing Friday 16th August 3pm
CEO of company has been given until 19th July 2013 to respond to avoid the claim proceeding undefended or a default judgement being made. He has yet to respond.

24th June 2013 - Received letter from ACAS to confirm they would be the conciliator and to try to resolve the matter without a hearing. They have yet to hear from the company
8th July 2013 - Received a third letter from the CEO stating that the company was no longer in a position to make payments for services rendered and I would have to contact the Redundancy Payments office to claim monies due. In this letter, they supplied a name, contact number and address of the company that would deal with the liquidation and provide all the necessary documents in due course.
9th July 2013 - CEO followed up with an email to say that the liquidation company had not yet been officially appointed and he would confirm this in due course. He has not been in touch since.

I can't imagine they will respond to the claim at this stage and it looks like they are holding off on liquidating too (because it costs money) which means I can't claim from the redundancy office. uurghh....

I have also heard through the grapevine that they have moved all the office equipment to the CEO's rented residence so if
bailiffs come knocking there will be nobody home!!

Any help on what I can do next would be most welcome. Thank you
