    I have spoken to the union again who have chased this up with HR.

    They advised it is being looked into and is being chased continually for a solution

            It might not be a bad idea for yourself and your union to approach HMRC about the strange pay system your employer has. I do know that HMRC investigates employers who do not comply with NMR regulations or fail to pay. Experience has shown that low/no paying employers often have issues relating to VAT, PAYE, Corporation Tax, NI.

              There is nothing at all strange about the pay system - the employer is paying for hours worked and this is common practice, and entirely lawful, if the employee is not working full hours, which they are not. HMRC do not investigate failures to pay - that is a matter for employment tribunals.
