I have been working for my current employer for 7 years and have always enjoyed a good working relationship. I am now planning to relocate and as I wanted to do the right thing by my boss I notified him in November we were selling our house and that when it was sold I would be moving. At the time he was happy for me to give my contractual one month's notice on exchange of contracts and to start looking for a replacement in the meantime. The idea being that I would ensure a good handover to the replacement and get all loose ends tied up before leaving. There are also a number of projects that I could take on should we find the replacement quickly.
We have now sold the house and I am being pressured to commit to a leaving date in 3 months time which, if the sale were to fall through would leave me with no job and a mortgage to pay. They have said that they could provide me with up to 3 months further work on a consultancy basis but are not prepared to commit to a minimum term for this work. Nor have they discussed pay with me, I would however no longer be an employee which would potentially cause IR35 issues.
Can they force me to give formal notice at this stage?
I would appreciate any help or advice as I really do not know what to do.
