Evening all, I need some major advice. I was made redundant from HMV on the 11th January (before the administration of the company) and was told that my final wages and redundancy payment would be with me shortly. HMV then went into administration a week later, and after constant calling, I was told to wait for further information from Deloitte about the situation. I now get a call telling me that my redundancy and final pay - expected today - has been recalled. The final pay has been rescheduled for this coming Tuesday and the redundancy pay is now void and won't be paid. I have been told that I must now seek it from the government and the RPO (they will send me a form next week).
I just want to know how legal this is, as I know I won't get my full redundancy through these channels. Can they legally recall a redundancy settlement made before a company has gone into administration (I have the paperwork to confirm the exact date of my redundancy)? Can I challenge this in any way? And what about changing the final pay date?
