  • health and safety rep off sick, accident at work

    among my other titals, i am the trade union appointed health and safety certificated representative for my office of about 150 staff members. i am fully qualified up to occupational health level

    i have been off sick for the last eight weeks due to a big operation on my knee.
    any health and safety issues are being relayed to me through the office IR REP

    on saturday a serious incident occured on the loading bay involving a 17.5 tonne vehicle.
    a driver was standing in the footwell of a transit, drivers side, getting his lunch box out of the van,

    the 17.5 tonne vehicle while turning off the loading bay took the side door off the transit van while he was standing in the footwell. the driver of the transit was unhurt but shaken.

    i have since found out that the accident has been reported eclectronically at the 17.5 ton lorry drivers depot about the damage only

    BUT, NO MENTION OF THE DRIVER IN THE TRANSIT VAN

    i sent an email to the office manager stating that the incident needs to be reported as a

    RIDDOR,

    AS THEIR WAS CLEARLY A RISK OF INJURY ,DEATH, AND A DANGEROUS OCCURANCE DID HAPPEN

    the response i got back was basically, you are on the sick, it has nothing to do with you

    SO MY QUESTION IS

    does an employer have to inform the dedicated health and safety rep of this incident (RIDDOR)even though he is off sick

    i have checked the safety representatives/safety committee regs with no joy

    to say i got my heckles up was an understatement, before i involve the HSE

    COMMENTS PEOPLE

    THEY ARE NOT GOING TO SWEEP THIS UNDER THE CARPET, THIS INCIDENT NEEDS TO BE INVESTIGATED AND MEASURES PUT IN PLACE TO STOP IT HAPPENING AGAIN
