Who decides the level of compensation at an Employment Tribunal

Hi People,

quick question, how does the court decide on how much compensation should be awarded for a successful case based on unfair dismissal and disability discrimination.

We have put in for £50k, however the solicitor says that this figure doesnt really mean anything as its at the judge's discretion. Does this statement from the solicitor hold any truth?

In all probability, yes. However, there is discrimination under one of the protected issues under the Equality Act 2010, in your case, disability, which could have a bearing on the level of damages the ET awards. The Michalak case probably sent a lot of employers running to change their underwear at the level of damages awarded - £4.1million - and from what I understand, judges appear not to be very tolerant of bullying and discrimination. Our more learned members would be the best to advise on the specific issue you raise in your post, however.
