    That does prey on our minds that if the prospective employer gets wind then no job will be forthcoming, but we can't (literally) afford to think like this. The old saying 'what goes around comes around' and I really can't wait for that day.

      Hi

      More advice required, I have now instructed a solictor , to act on my behalf, they are still refusing to pay and wont deal with my sol. If they are not paying I'm I still an employee?

        They will have to deal with your lawyer because otherwise you will sue their ass thru the Tribunal.

        It sounds like they are burying their heads in the sand & don't know what they are doing. They will of course also be using this time to build up all sorts of **** against you and its amazing employers can drum up, most of which will get chucked out as irrelevant by the Tribunal. Either you are guilty of specific acts of gross misconduct or you are not. The burden of proof is on them to prove it. If you are not guilty of GM then you will eventually get both your full notice pay and compensation.

        Make sure you keep on top if your solicitors so that you keep within the timescales imposed by statute for bringing a claim for unfair dismissal. Do not hesitate to see another lawyer if you have any instinctive doubts about the one you have consulted - you need a specialist in Employment Law.
