  • Procedures for issuing a letter before Claim when insurance company is involved.

    I have raised a personal injury claim against my employer. I was using legal representation via my Union, which has proven to be a waste of time and stated they can no longer represent me when I mentioned the defendant had breached the courts process by destroying all evidence.. The solicitors were dealing directly with my companies Insurance company.

    I have now issued a letter before claim to the insurance company as I was informed by the solicitors that all communication must go through them via him. As the solicitors no longer represent me. should I have sent the Letter before claim to my company as well as their insurance company?

    Yes, the defendant in your claim will be your company.

    If you have to continue with a court claim and intend to represent yourself as a LIP there is much info about negligence and injury compensation (including an example of a particulars of claim) at www.lawteacher.net

      I really appreciate the info. I will take a look at it in the morning.

      I sent the Letter before Claim a week ago to my companies solicitors. I guess the clock resets when I send it to my company.
