  • HMRC Self Assessment Late Submission Penalties

    Hi,

    After some advice concerning submission of self assessment tax return.

    I retired in 2019 and received an early retirement package. Due to the amount of monies received, I had to complete a Self Assessment, which I completed and received a tax rebate.

    This was the 1st time, I had completed a self assessment return since 2006. Always been PAYE.

    Therefore after retirement and receiving a pension, I did not believe that I had to complete any further self assessment returns.

    I recently had a tax query and spoke to HMRC on 3 occasions to clarify and received confirmation that I owed no tax.

    After my call this Monday morning, I received an email at Midnight advising that I owed £100 penalty for late filing of my 2020/21 SA return and then at 3am on Tuesday another email advising that I owe a £1,500 penalty for late submission.

    I do not believe that I had to file any return as my pension is fully taxed and will be appealing.

    Can HMRC send me these penalties without any reminders 2 years 9 months after the return was due? I have never received a reminder or notification of when the penalties were due until this week.

    The only notification I received was 05/04/21 via the HMRC app, did not receive any notification in the post, hence I didn't even look at the app and didn't use it.

    Firstly are you sure that the emails are legitimately from HMRC as there are many well published incidents of scam HMRC emails?

    I appreciate that you had confirmation that you owed no tax but have you received confirmation that you no longer need to complete a self-assessment. Once you complete your first self-assessment, as far as I am aware, you remain on that requirement until notified by HMRC that you no longer need to complete a self-assessment.

    That said HMRC are very good at sending email / app / postal reminders for having to complete your self-assessment both before and after the due date. Initially I would just give them a call and see if you can find out is going on.

      Thanks for response.

      I am going to call them to discuss.

      The emails sent are what is displayed within the App.

      I understand your point that once a person completes a SA, then that remains in place until HMRC state otherwise.

      However, I only received 1 message on April 5th, 2021 requesting submission of SA for 2020/21. Never received any further emails, reminders, post and no requests to complete SA returns for 2021/22, 2022/23 or 2023/24. If that were the case, then I would owe penalties for a further 2 returns.

      As stated I missed the message on the app from 2021 and that is the only message or post received until Oct 8, 2024, so 42 months!

        I do have potential mitigating circumstances being that I didn't consider it a legal obligation to complete (one of their outlined reasons), coupled with the fact that I was under review from Sept 2021 through to May 2022 for potential lymphoma (have all the medical records) and before all clear my father died, hence managing estate and caring for elderly mother since.
