Employment Tribunal vs County Court

Hi,
I am thinking of making a discrimination claim against my previous employer, however over 3 months have now passed (but less than 6 months).

I have read that in Civil / County Court, you get 6 months to start a discrimination claim. So I was thinking that maybe I could make the claim to County Court instead. I am unsure on whether I am correct about this or not. Am I able to make a discrimination claim against my employer in County Court instead of the Employment Tribunal? And if yes, would the time limit be 6 months in County Court?

If I cannot make a discrimination claim against my employer in County Court, and I am now out of time to make a claim to the Employment Tribunal, what do you suggest I do next? Is there anything I could do instead?


I was thinking I could attempt to make my claim to the Tribunal, and hopefully they would accept it out of time. Alternatively, I was thinking that I could see if there are any other laws that cover my complaints (or incidents I wish to make a claim about) and would make my claim on time.

If your claim.is discrimination against your previous employer then it is an employment tribunal claim.however the time limit is 3 mo the less a day.

If you want to try to make an out of time claim them you willl need to habe good reason/s aa to why you did not make the claim in time.

Would you be willing to explain the situation with little bit more information? Are you saying its been more than 3 months since the last instance of discrimination? Are you still employed by them? Just a brief outline will do, nobody needs War & Peace!

As ULA said, when it comes to employment related discrimination, the time limited is 3 months minus 1 day. The 6 months you refer to is when you experience discrimination in your day-to-day life i.e you are refused entry venue because you have a disability.
