  • Taking my rouge ex employer to Tribunal - WHISTLEBLOWING

    Hi guys, I was unfairly dismissed by my employer for repeated raising safety concerns. My ex employer failed its legal obligations and endangered the health and safety of customers as well as staff. The reviews on the internet are full of issues customers are complaining about, the same issues that i have been repeatedly raising with them but they ignored me everytime or told me these issues do not exist or are getting better. Soon we are to send each other documents relevant for the case. How do i get them to send me data like how many customer complaints they received every month along. with reasons of complaint in a table form? Thank you.

    You may struggle to get them to provide that data, as they may say it is commercially sensitive information.

    However if as you say, there are reviews on the internet regarding the same safety concerns you raised, for which you believe you were dismissed as a whistle-blower then this is publicly available data. You can make your own table about the number of complaints and reasons over a particular period so long as you reference the source of that data.

      Thank you so much. I also named 4 witnesses but they have all gone quite. What to do if none of them want to come give a statement? They have obviously seen what happened to me for speaking up

        Hello, have you spoken to Protect? They are a charity that supports Whistleblower and give invaluable support and legal advice about it all. I'd definitely recommend you speak to them.

        As for witnesses if the don't want to make a statement then theres not a lot you can do about it. If your ex employer has treated you badly because of it all then they're probably willing to treat others the same way and the witness may well know this.

          I did speak to protect actually who told me because my case is already in the tribunal, they cant do much. They told me to contact a solicitor to seek legal advice. not helpfull at all

              I got advice from them up until the the first court hearing in my ET claim, and help straighten out the half attempt of a claim my initial solicitor made. They don't help beyond that is what I was told and I'm not sure what the reason is, but I'd have a guess at limited resources and liability.

              Hope your claim is going well, and as for being told to speak to a solicitor to get legal advice, I'd say that I've had better information on this forum and from citizens advice than from my solicitors.
